It's been quite a while since Stan Lee's death, however, it seems like the battle for the Marvel comic book legend's intellectual property continues. Last year, JC Lee, Stan the Man's daughter, filed a suit against POW! Entertainment so that she could win back her father's intellectual property from the company. Now, it looks like POW! has filed to dismiss JC Lee's "grossly selfish" lawsuit.
According to The Hollywood Reporter, the lawsuit's next hearing is going to take place on February 24. The team of attorneys working for POW! have notified the federal court system and the Central District of California that it plans to submit a motion to dismiss the suit by JC Lee.
POW! serves as the owner of Lee's non-Marvel intellectual property and likeness rights after the comic book legend helped launch the company in 2001. While JC Lee did file a case against POW!, the lawsuit originally didn't seek to demand monetary damages from the company. Instead, Lee's daughter wanted POW! to acknowledge that Stan the Man's intellectual property and likeness are owned by his trust, not by the company.
However, the company's attorneys Chaz C.Rainey and A. Raymond Hamrick III say that the suit is "fatally flawed" because the plaintiff has "no standing to bring the claims."
Before Lee's death, the comic book writer and writer filed a similar suit against POW! that demanded $1 billion in damages. However, Lee dropped the suit a few weeks after it was filed and went on to give a statement saying that he was "thrilled to put the lawsuit behind me, get back to business with my friends and colleagues at POW! and launch the next wave of amazing characters and stories."
We wonder how this new lawsuit with JC Lee will turn out as the fight for Stan Lee's intellectual property rights goes on.
