Aquaman and the Lost Kingdom is DC Studios' final film to be released this year before the full-blown shake-up within the franchise rebranded as simply the "DC Studios" takes place. Over the last couple of months, there's been growing uncertainty within the fandom surrounding James Gunn and Peter Safran's plans that will only seem to benefit a number of actors in the current roster.

Going back to the Aquaman sequel, it looks like the project is in danger of receiving a lawsuit for a case similar to what Universal Pictures had to deal with. Last month, Variety reported that film outfits can now be legally sued for false advertising and presenting deceptive material about the appearances of actors in a movie trailer as per a new court ruling from U.S. District Judge Stephen Wilson.

This is in relation to Ana de Armas' inclusion in the trailer of the Beatles-inspired film Yesterday which made it seem that she had a substantial role when she was only spotted through a photograph.

So, how exactly does this connect to Aquaman 2? Bounding Into Comics reports that Warner Bros. could suffer the same legal fate with the studio potentially becoming subject to a class action suit filed by fans.

"Warner could become subject to a class action suit subsequently filed by people who went to see the new Aquaman and either hoped Heard wasn’t in it or expected she wasn’t. The company would then be liable for damages and restitution of all that money spent on tickets costing upwards of $20 in some places if not more," the outlet writes.

As it stands, Amber's DCU status remains unclear but many are under the impression that she's been removed from Aquaman 2. WB and DC Studios have yet to address the matter which makes it all the more intriguing.

Meanwhile, Aquaman and the Lost Kingdom is slated for release on December 25, 2023.
